Terms of Service

Effective from: 1 January 2026

1. Introduction

These terms govern the use of the FRED Cloud service operated by 2CREATE, s.r.o., Hálkova 9, 831 03 Bratislava, Slovakia, Company ID (IČO) 35 937 483 (“2CREATE”). The contractual relationship with the developer (customer) is further governed by the General Terms and Conditions of 2CREATE, in particular Art. 13 (FRED Cloud), and by the data processing agreement.

2. Access and accounts

• FRED Cloud is a proprietary system of 2CREATE; the developer obtains a licence to use it, not ownership.
• User accounts are created by 2CREATE or by an authorised user of the developer. Each user has their own account, must not share their login credentials and must use two-factor authentication where the application supports it.
• The scope of features is determined by the developer's plan (Freedom, Advanced, or Štart, Predaj, Premium).

3. Obligations of the developer and users

• Enter into and send through FRED Cloud only data that the developer is entitled to process (in particular based on consent or another legal basis under the GDPR), and inform the data subjects accordingly on its websites and in its forms.
• Not use the service for unsolicited bulk messaging, unlawful content or circumventing security.
• Ensure the accuracy of data and the permissions of its users.

4. Third-party integrations

• Integrations (Meta, Google, WhatsApp, RealPad, Mailchimp, Ecomail, Pipedrive, Inverest and others) are enabled by the developer. When using them, the developer is also bound by the terms of the respective providers.
• 2CREATE is not responsible for the availability, changes or limitations of third-party services (e.g. an API change or an account being blocked by the provider).

5. WhatsApp

• By connecting a WhatsApp Business number, the developer also agrees to the WhatsApp Business Terms of Service and the WhatsApp Business Messaging Policy of Meta.
• The developer is responsible for ensuring that prospects have agreed to communicate via WhatsApp (e.g. via a checkbox in a form or by initiating the conversation themselves) and for the content of messages sent by its sales agents.
• Messages sent from FRED Cloud are subject to Meta's rules (24-hour customer service window and approved message templates); any Meta fees under Meta's pricing will be re-invoiced by 2CREATE.
• 2CREATE is not responsible if Meta restricts or blocks a number for violating its policies.

6. Availability and changes to the service

2CREATE continuously develops the service and may change its features; it announces significant changes in the “What's new” section. Planned maintenance is preferably carried out outside business hours.

7. Termination

Upon termination of the contract, 2CREATE will allow the developer to export its data and will delete it after the agreed period of 30 days, except for data it is required to retain by law.

8. Liability

The scope of 2CREATE's liability is governed by the General Terms and Conditions of 2CREATE.

9. Final provisions

These terms are governed by the laws of the Slovak Republic. 2CREATE may amend them; the current version is available on this page. The processing of personal data is described in our Privacy Policy.
